63. 鉛及鉛化合物 (Lead and its compounds) CAS No 7439-92-1 EC No 231-100-4 | Shall not be used in articles made from polyvinyl chloride (PVC) polymers or copolymers. Lead (expressed as Pb metal) shall not be placed on the market in PVC articles if the concentration is equal to or greater than 0.1% by weight of the PVC material. Articles 15 and 16 shall apply from [OP, please insert the date corresponding to 24 months + 1 day after the entry into force of this Regulation]. By way of exemption, Articles 15 and 16 shall not apply to the following finished PVC articles containing recycled rigid PVC until [OP, please insert the date corresponding to 10 years after the entry into force of this Regulation], if the concentration of lead (expressed as Pb metal) is less than 1.5% by weight of the recycled rigid PVC and if a layer of new production PVC or other material is placed over the recycled rigid PVC and the concentration of lead (expressed as metal) in that layer is less than 0.1% by weight: profiles and sheets for exterior applications in buildings and civil engineering, excluding decks and patios; profiles and sheets for decks and patios, where recycled PVC is used as an intermediate layer and is completely covered with a layer of new production PVC or other material; profiles and sheets for concealed spaces or voids in buildings and civil engineering (places inaccessible during normal use, excluding maintenance, such as cable ducts); profiles and sheets for interior architectural applications, where new production PVC or other material is used over the entire surface of the profile or sheet; multilayer pipes (excluding drinking water pipes) where recycled PVC is used as an intermediate layer and is completely covered with a layer of new production PVC or other material; fittings, excluding fittings for drinking water pipes. Recycled rigid PVC from the categories of articles mentioned in points (a) to (d) may only be used in the production of new finished articles of any of those categories.
Before placing on the market finished PVC articles made from recycled rigid PVC containing a lead (expressed as metal) concentration equal to or greater than 0.1%, suppliers of PVC products shall ensure that they are visibly, legibly and indelibly marked with the statement: "Contains lead". If this cannot be marked on the finished article due to the nature of the finished article, it shall be marked on the packaging of the finished article.
Suppliers of finished PVC articles made from recycled rigid PVC shall, upon request, submit to the enforcement authorities written evidence to substantiate the recycled origin of the PVC in these articles. Certificates issued by authorities providing proof of traceability and recycled content, such as those developed in accordance with EN 15343:2007 or an equivalent recognized standard, may be used to substantiate such claims for PVC articles produced in the EU. Claims of the recycled origin of PVC in imported articles shall be accompanied by a certificate issued by an independent third party providing equivalent proof of traceability and recycled content. By [OP, please insert the date corresponding to 5 years after the entry into force of this Regulation], the Commission shall review this paragraph in the light of new scientific information and, where appropriate, amend it accordingly. By derogation, Articles 15 and 16 shall not apply to: PVC-silica separators in lead-acid batteries until [OP, please insert the date corresponding to 10 years after the entry into force of this Regulation]; articles covered by Article 1, pursuant to Articles 2 to 5, and by Article 7, pursuant to Articles 8 and 10; articles within the scope of: Regulation (EC) No 1935/2004; Directive 2011/65/EU; Directive 94/62/EC; Directive 2009/48/EC. By derogation, Article 16 shall not apply to PVC articles placed on the market until [OP, please insert the date corresponding to 24 months after the entry into force of this Regulation]. |
