| 46 | Cadmium and lead in plastic profiles containing mixtures produced from polyvinyl chloride waste (hereinafter referred to as "recycled rigid PVC"), for use in electrical and electronic doors and windows, with the cadmium content of the recycled rigid PVC material not exceeding 0.1% by weight and the lead content not exceeding 1.5% by weight. From May 28, 2026, rigid PVC recycled from electrical and electronic doors and windows may only be used in the production of new products within the categories specified in points 18(a) to (d) of Annex XVII, entry 63, to Directive (EC) No. 1907/2006 (REACH). Suppliers of PVC articles containing recycled rigid PVC (with a lead content of ≥ 0.1%) shall, before placing these articles on the market, ensure that they are clearly, legibly, and indelibly marked with the words: "Contains lead ≥ 0.1%." If this cannot be indicated on the article due to its nature, the packaging of the article shall be marked accordingly. Suppliers of PVC articles containing recycled rigid PVC should, upon request, submit written evidence to national enforcement authorities to substantiate the recycled origin of the PVC in these articles. Certificates issued by schemes providing proof of traceability and recycled content, such as those developed under EN 15343:2007 or an equivalent recognized standard, may be used to substantiate such claims for PVC articles produced in the EU. Claims regarding the recycled origin of PVC in imported articles should be accompanied by a certificate issued by an independent third party providing equivalent proof of traceability and recycled content. | Applicable to Category 11, valid until May 28, 2028 |
